This privacy policy describes how Pitcher AG (“Pitcher”) collects and uses the personal information you provide on our web site www.pitcher.com and service by Pitcher (the “Service”) and the related Pitcher Tablet Software for tablet computers (“Tablet Software”). It also describes the choices available to you regarding our use of your personal information and how you can access and update this information. The use of information collected through our service shall be limited to the purpose of providing the service for which the Client has engaged Pitcher.

Information Collection and Use

We collect the following personal information from you, contact information such as name, email address, mailing address and phone number, unique identifiers such as user name, account number, password. We also collect the following information from you, information about your business such as company name, company size and business type.

When you download and use our Services, we automatically collect information on the type of device you use, operating system version, and the device identifier (or “UDID”). We collect your location based information for the purpose of locating a place that you may be searching for in your area. We will only share this information with our mapping provider for the sole purpose of providing you this service.

We may share your geo-location data with third parties for the purpose of them serving you ads for places (such as restaurants) in your area. If you do not wish to allow us to share your information in this manner please opt-out by contacting us at info@pitcher.com.

We collect information for our clients, if you are a customer of one of our Clients and would no longer like to be contacted by one of our Clients that use our service, please contact the client that you interact with directly.

Service Provider, Sub-Processors/Onward Transfer

Pitcher may transfer personal information to companies that help us provide our service. Transfers to subsequent third parties are covered by the provisions in this Policy regarding notice and choice and the service agreements with our Clients

Access to Data Controlled by our Clients

Pitcher acknowledges that you have the right to access your personal information.  Pitcher has no direct relationship with the individuals whose personal data it processes. An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data should direct his query to the Pitcher’s Client, the data controller. If the Client requests Pitcher to remove the data, we will respond to their request within 30 business days.

Data Retention related to the Service

Pitcher will retain personal data we process on behalf of our Clients for as long as needed to provide services to our Client. Pitcher will retain and use this personal information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Information Sharing

We will share your personal information with third parties only in the ways that are described in this privacy policy.  We do not sell your personal information to third parties.

Service Providers

We may provide your personal information to companies that provide services to help us with our business activities such as live chat help or hosting provider. These companies are authorized to use your personal information only as necessary to provide these services to us.

In certain situations, Pitcher may be required to disclose personal data in response to lawful requests by public authorities, including meeting national security or law enforcement requirements.

Opt-out Preferences

If you wish to subscribe to our newsletter, we will use your name and email address to send the newsletter to you. Out of respect for your privacy, you may choose to stop receiving our newsletter or marketing emails by following the unsubscribe instructions included in these emails.

We send push notifications for download notifications. If you wish to opt out of push notifications, please adjust settings from the device level.

We may provide you the opportunity to participate in questionnaires or surveys.  If you participate, we will request certain personal information from you. We partner with a third party to either display advertising on our website or to manage our advertising on other sites.
